Why Law Firms are Struggling with Client Acquisition – The 7 Game-Changers

Clients are the lifeline of any company, and law firms are no exception. Without clients, you don’t have an organization to run. And in order to get clients, there are several factors that you need to focus on in order to get the perfect client acquisition for your law firm.

Now, when harnessing the power of digital platforms, it is important to understand that combining a few random tricks wouldn’t work for you. Instead, you will need to integrate a full feature-pack strategy in order to escalate your client acquisition strategy.

If you realize that your law company is having a hard time acquiring new clients, consider the following seven points and try to improve your firm’s current situation.

1. Lacking in Concentration

In any business, focus and concentration are everything. There’s popular marketing saying that ‘when a business is marketing to everyone, it is actually marketing to no one. And this is 100% true. Law firms are just like other businesses, and the same rule also applies to them.

Think from a client’s perspective. Who would you choose if you were a potential client looking for an employment discrimination lawyer? Your options are discussed below:

  • A general practice law company specializes in criminal law, start-ups, discrimination, medical malpractice, business law, and more. They claim to be best at every law aspect.
  • A discrimination law firm that has a pool of expert, qualified, and experienced lawyers or legal advisors in employment discrimination. This firm takes pride in knowing that it has won many employment discrimination cases.

If you choose the second one, you’re exactly thinking like the potential clients.

2. Understand the Market

The important rule to owning and running a successful business is identifying the people who may need your service. This means that you understand how your audience becomes eligible to be your possible clients and form where they come from.

For instance, if a law firm only focuses on giving services to start-ups or small-scale business setups, it would probably know that its target audience frequently visits crowdfunding sites or sites that help entrepreneurs establish their businesses around the country.

3. Maligned Reviews & Testimonials

In the twenty-first century, reputation management is more important than ever. With online platforms taking over every aspect of our world and becoming increasingly popular amongst the common people, if you’re not taking out some time to monitor these platforms and address any negative reviews about your firm, it can hurt your business. Instead, you must understand the power of these platforms in order to get the best online reputation management for your law firm in Dubai.

It’s particularly not very important to exist on these review sites, but it is very important to know that these sites exist for a reason. Plus, you should occasionally check these sites to respond to good and bad reviews about your company. This is an act that visitors typically see about a company, whether or not they are concerned about their online reputation.

4. Good Graphic Representation

Most law firms still don’t take it seriously. Adding your headshot to your professional accounts and website is extremely important because it easily communicates the credibility and authenticity of your law firm. For example, Mai Alfalasi, the leading law firm in Dubai, is highly focused on the use of great graphical representation as it has helped us in a plethora of ways for client acquisition.

Moreover, humans are naturally tempted by images, and in today’s digitally-advanced world, visuals play an integral part in making or breaking your company. If your website is messed up with content without having appropriate images, you won’t look professional in front of your audience. Further, if you don’t add your image, the potential clients won’t be able to imagine the person winning their case. They’ll quickly look for another law firm regardless of your experience and qualification.

5. Missing Mobile-Friendliness

Is your law site mobile optimized? Remember that mobile enablement has taken our world by storm. According to Statista, half of the worldwide web traffic comes from mobile phones, which account for more than 55% of total web traffic. If it isn’t, then this could be a reason your clients are not taking an interest in your firm.

This means people are not able to see or interact with your website through a smartphone. Plus, if they can’t see you online, they’ll switch to the rival company, which is available at all times.

6. Unpopularity among the Current Clients

Unpopularity among the existing clientele is another huge reason, as most clients in the law profession came through referrals or word-of-mouth. If existing clients don’t like you, this is a huge problem for your law company.

Why? It has been found that word-of-mouth and referral sources are the biggest sources of attracting new clients for any law company. If a business attorney is dealing with a client who owns a successful business, there are high chances that this client networks with other business owners and may recommend you to others.

7. Poor Digital Marketing Measures

No matter if you like it or not, the future is digital marketing, which includes search engine optimization, social media marketing, content marketing, email marketing, and whatnot.

Remember that lacking in the digital marketing endeavors can destroy your digital brand’s effectiveness while reducing the current client base as well. Moreover, it also results in budget problems, low client volume, and sometimes results in the closure of a business.

So, this digital marketing can be a true game-changer for your law firm. It is a technique that helps your law agency attract traffic from search engine sites like Google. Having an optimized site filled with correct keywords is the key to getting profitable clients from the web.

What to Do if Fired From Job in Dubai – Know Your Legal Rights

When we talk about the highest and biggest job markets in the world, the name UAE is sure to come to mind. Indeed, from small to big industries, the UAE hosts tons of opportunities for employees from different sectors and fields. This is why hundreds and hundreds of new aspirants come into the UAE with the hope to land their dream job or particularly find a better living than in their home country.

The quality of life, work-life balance, and environment in the UAE are unparalleled. In fact, it offers tons of opportunities to potential candidates to live a healthy and better life in the UAE. These are some of the reasons for the massive expat population in the UAE.

However, the top-notch legal firm in UAE, Mai Alfalasi, recommends that it is pivotal to know the legal rights so that you can handle the things in a legal way and the way that benefits you. The government of the UAE has devised and formulated labor laws so that the foreign employees have the best working conditions as well as a conducive environment.

The New Labor Law of Dubai

Understanding the new labor law of the UAE becomes pivotal before we proceed to any other thing. According to the latest amendment in the labor of the UAE that comes into effect on 2nd February 2022, the government of UAE is being vigilant and changing the lawsuits to increase their effectiveness as in the developed nations. More precisely, they are elevating the labor laws in the UAE and comparing them to that the global standards.

The new amendments in the labor law have been around the employment law, leave provision, contracts issuance, and renewal, introduced a new working week, minimum wage, and termination of an employee from their position. The primary focus of devising this labor law in the UAE is to safeguard the rights of all working people from the private and public sectors.

The introduction of new terms and guidelines have been summarized in the new amendments in the labor law for the employees in the UAE. The Federal Law no. 8 of 1980 (regulates employment relations in the UAE), the Federal Law no. 6 of 1973 (Immigration and Residence) all the amendments, and Federal Decree-Law no. 17 of 2017 (Immigration Law) cover in detail all the rights enjoyed by employees when they are termination from their jobs. In this new law, three new terms and conditions have been put for all the employers to abide by upon the completion of the contract or even termination of the contract;

  • The first is if the term of the contract is expired and not renewed.
  • The second is when both parties mutually agree to terminate the contract.
  • The third is if the employee commits a violation of their job roles as mentioned in Article 120 of labor law.

The labor law clearly and succinctly explains the immediate payment of EoSB to the employee upon termination of the contract, except for the cases where the termination is due to misconduct or violation of extreme rules.

Now, this is where the termination of an employment contract may vary. The employees can take both ways by enforcing the legal obligations and enjoying the benefits.

Legal Rights in Employment Contract

In order to know more about the legal laws and compliances that you can get in the UAE, here are the rights that you must know for safeguarding your legal way. These are provided by the leading legal consultants in Dubai at Mai Alfalasi.

1. Receivables & Dues

The clearance of receivables and dues entirely depends on how you actually get terminated from your job. If the organization has taken a step further in the wake of cost-cutting, you are obliged to receive the gratuity pay and, in some cases, the notice period compensation. However, if you are wrongfully terminated from your position, and the organization failed to present a valid reason for your termination, you are entitled to get the gratuity and other dues.

2. Post-Service Benefits

In UAE, the end of service benefits (EoSB) are highly monitored and served with legal regulations to serve justice at all times. However, it is paramount to remember that an employee is not entitled to receive an end of service benefits if found involved in any sort of misconduct on the job role. Generally, all the employees who have completed one year of service become eligible for gratuity or end of service benefits.

Moreover, Article 132 of employment and labor law in UAE says the following about the end of service benefits;

  • 21 days’ pay for each year of the first five years of service.
  • 30 days’ pay for any additional year.

3. Notice Period

All the employees intending to leave the organization must serve a notice period that is agreed upon while entering the contract. Now the scenarios may vary where the employee can simply leave the company of their own goodwill. But be very mindful that in case of doing so, they have to serve the notice period, and if they are willing to get a waiver on the notice period, they must compensate the employer.

The same goes for the employer as well in Dubai, as they also have to follow the same legal proceeding. The duration of the notice period in Dubai may vary from 1 to 3 months in total, and each party must fulfill the notice period without having to compromise on the legal way of conducting things.

However, in some of the cases, our legal consultants have handled, if you have served the 3 months notice period, you are not entitled to serve anymore. In fact, the employee then becomes entitled to receive full wages during the notice period.

4. Uncertain Medical Reasons

Uncertainty can strike anytime, and medical uncertainty is inevitable in some conditions. Therefore, if a company dismisses an employee for medical unfitness although they cannot, employees can take legal action against them. However, it is important to note that the termination and legal action may vary if the employee has taken legal leaves and is continuously absent from the position.

5. Grace Period Exceptions

The government of UAE provides 30 days grace period after the cancellation of an employment visa. However, a new amendment has been proposed to the government to extend the time of grace period to 180 days. But it is still to get a ruling. However, if you have maintained good relations with the employer and ask them not to cancel your visa until you land another job, a probable option can be a potential gateway.

Everything to Know About the New Trademark Law in Dubai, UAE, in 2022

Over the years, the definition and understanding of a trademark have been prolonged, and the non-conventional and formerly-used trademarks have been given more meaning and explanations. Today’s businesses or individual entities can easily apply for their 3D holograms and voice trademarks. Moreover, the filing of multi-cases trademarks law also becomes possible with this. Earlier, UAE’s legal system has only worked on a single class filing process, which has now been elevated. And Mai Alfalasi – the leading advocate and legal consultancy in Dubai, helps in trademark services in regards to the new law.

On 20th September 2022, the President of the United Arab Emirates issued decree No. 36 of 2022, particularly in connection with the law for trademarks. However, the law affected from the 2nd January 2022. The introduction of this law for trademarks, the previous implemented and affected Federal Law No. 37 of 1992, and all of the amendments it has undergone have been canceled. Nevertheless, it is important to note that all the previous filed and applied cases will be solved and dealt with by the former law, and no retrospect will happen.

What is a Trademark?

According to Article 2 of Law No. 36 of 2021, the trademark for any business is a legal representation that protects the specific, unique name, logo, and symbols pertaining to your products or business brands. In Dubai and other cities of the United Arab Emirates, the meaning and function of a trademark are more or less the same.

Any trademark is the distinctive mark that includes the words, symbols, names, letters, signatures, drawings, simple colors, combinations, numbers, engravings, shapes, pictures, or figurative elements that, with a set of perfect design and color combination gives a unique meaning and representation for your business or enterprise anywhere in the world.

Moreover, a trademark can also contain a three-dimensional hologram depicting any specific mark or symbol used to distinguish goods or products. Further, any undertaking that includes an olfactory mark (smell mark) also comes into the umbrella of a trademark according to the newly announced and imposed rule.

Types of Trademarks in Dubai

Now that we have learned what a trademark is, the next step is to understand the types of brands in Dubai for small, medium, or large-scale enterprises. The trademarks have a particular set of subtypes that divides them and better explains them following different businesses. Having said this, here are the five major types of trademarks that can best be used in regards to your business type or category;

Arbitrary and Fanciful Trademarks

Arbitrary and fanciful trademarks are the typical ones that are on a distinctive spectrum. The purpose of their creation is for certain brands for which the existing words or designs are used for context to represent a specific product. An example of it can be taken for a brand ‘Kodak.’

Suggestive Trademarks

The second is a suggestive trademark used to design to encourage a customer’s imagination and create specific characteristics of a product. An example of it can be understood from the leading brands like Jaguar and Greyhound.

Descriptive Trademarks

Descriptive trademarks are another type of trademark used for business and used at the bottom of the packaging for describing and explaining any goods and services.

Generic Trademark

Moving on to another, we have a Generic Trademark that is generally applied and used by commonly operated businesses. It is usually composed of a single phrase describing the business itself.

Suggestive Trademark

A suggestive trademark is one of the classes of trademarks that commonly explain the business, its goods, services, etc. the intent of creating a figurative trademark for your business is to protect your business of name without having a second meaning.

Important Things that are not Trademarks

It is pivotal to understand that everything isn’t a trademark. However, many people misunderstand trademarks with a lot of other factors. Only if we all clearly understand what a trademark is, the entire process becomes way easier. With this being in mind, here are the things that are not trademarks and are often confused with them;

  • The simple marks are comprised of numbers or designate nature.
  • The drawings, signs, and expressions already in contravention with public order and morals are not allowed to be selected as a trademark.
  • The specific symbols of the Red Cross or any other related symbol are not categorized into a trademark.
  • All the marks, signs, or symbols that reflect any religious body do not fall into the trademark umbrella.
  • Be aware that marks of military insignia or that of flag or any country are also not considered the trademark.
  • Those marks are purely indicative of the geographical origin of any goods as it births confusion in the customers' minds regarding your business.
  • The use of common names, surnames, and other names can’t simply be categorized in trademarks because of the issues related to uniqueness.
  • Special marks that belong to entities are prohibited from being categorized into trademarks as it is entirely forbidden in the United Arab Emirates.
  • Another thing to note is that those marks that resemble other trademarks are prohibited from being undertaken.
  • An academic degree cannot be placed or opted for as a trademark because of the illegitimate entitlement.
  • Another strictly forbidden is the use of such marks that are misleading regarding any specific business, products, or services.
  • The registration or application for a well-known mark is not allowed because of special permission required from the party or the owner. If the trademark owner is out of the UAE, the person or the mark owner needs to sign a document, not object to the use.

  • Violations of HR policies as defined by the UAE companies.
  • Bouncing of payment cheques.
  • Disputes and quarrels related to real estate and property dealing include ownership disputes, eviction, and mortgage.
  • Complaints about delivery or an inappropriate or faulty product.

The lawyer or a professional advocate will never suggest you go with legal action without taking legal notice and reaching a settlement and agreement without accelerating the matter further. It will also result in saving a lot of valuable resources that might cost you more while battling legal to the party.

Filing a Lawsuit

If you have sent the notice, tried to resolve the matter, or even mediation, but have not found the solution, the next step is to submit to the UAE court your statement of claim that a legal advocacy team would do for you. This is where you will need the help of a lawyer to execute your case and help in documenting and making the representation easier. The attorney at Mai Alfalasi will deal with your notarization of all supporting documents for your case.

Getting Date and Count Hearing

As soon as our advocate in Dubai does the process of filing the case, the court clerk will serve notification to the defendant within ten days from the date the statement was filed. Then your advocate will provide you with a case number as well as the hearing date that the court has already given.

This leads to a result where the court official or bailiff will then send the defendant a notification within ten days from filing the statement of claim. Here, the prominence of a case will largely be based on the official estimation during the trial. Lastly, the valuation will be based on the last request made by both parties and will then lead to a final settlement.

Ending of Case

The ending of a case generally depends on the type of case reported or filed. For example, if it is a civil action case, the case will depend on both parties whether they wish to proceed with the complaint or resolve it there. This also leads to such results that might take up to six months from the date of the court’s approval as per Article 101 of Civil Procedural Law. This states that no party shall be allowed to expedite the case during this period, except with the consent of the other.
